ＫＴＫ英文明細書研究班の会合に出席して [特許英語の研究]
１月１３日、ＫＴＫ英文明細書研究班の会合に参加させて頂きました。
テーマは、
・藤芳寛治先生による、「米国特許出願基礎セミナー（第１回）」
・木村進一先生による、「AIPLA出張報告・英語スピーチのむつかしさ
－特許訴訟における特許無効の抗弁－」
の２本立てで、藤芳寛治先生、木村進一先生のご経験に基づく貴重なお話を伺うことができました。
藤芳寛治先生からは、クレームドラフティングにおける細かなテクニック、細かな英語表現のノウハウ、米国におけるジェプソンクレームの問題点などをご教示頂きました。
木村進一先生からは、日本の知財高裁の判決（平成１８年（受）第１７７２号（特許第2139927号））の英語での解説講義を頂きました。
講義の中で木村進一先生が「英語は、書くことも話すことも難しい」、とおっしゃっていたことが強く印象に残りました。先生は、英語に関する多くのご経験、ご執筆がある達人ですが、達人の先生であるがゆえに、本当の奥の深さ、道を極めることの難しさを理解されていらっしゃるのだと思いました（一流のスポーツ選手が、更なる向上に向けて弛まぬトレーニングを続け、飽くなき改善を図ってゆくことに似ていると思いました）。
明細書の作成、特許英語の世界をはじめとして、プロフェッショナル弁理士の業務は奥の深いものであることを実感し、さらに勉強を続け、研鑽を積む必要があることを強く感じました。

ヨーロッパでのクレーム表現の研究（EP0964166） [特許英語の研究]
Claims of EP 0964166 (A2)
3. A hydraulic control system comprising a hydraulic circuit (10) including a source (12) of fluid pressure,
an electrically operated valve (22) for controlling the pressure in a part of the hydraulic circuit,
a pressure transducer (28) for producing a pressure signal indicative of the pressure in said part of the hydraulic circuit, and
control means (30) arranged to supply an electric control current to the valve (22) to control the valve in response to signals from the pressure transducer (28),
characterized in that
the control means (30) is further arranged to monitor a temperature dependent parameter of the control current thereby to monitor the temperature of the valve (22), and to compensate accordingly for the effect of temperature changes on the pressure signal.

（１） ヨーロッパ系のクレームでは、クレーム中での「means」の使用も有利となることが多いものと思われる。
（２） 「means arranged to ...」（またはmeans configure to ...など）のmeansクレームの記載の仕方。こういった表現を勧める欧米の特許弁護士も多い。（means for ...と同じだ、という意見も多いが。）
（３） 「characterized in that」の使い方。

[0002] It is known to provide closed loop pressure control in a hydraulic system by monitoring the hydraulic pressure at a point in a hydraulic circuit, comparing the measured pressure with a desired pressure, and controlling the electrical current to an electrically operated valve, such as a solenoid valve, to open or close the valve to adjust the pressure in the system towards the desired pressure.
